Terms and Conditions for Sale, Delivery, and Payment

2. Scope and Subject Matter of the Contract
2.1 These General Terms and Conditions (GTC) apply to all registrations and purchases made via our online shop at www.autotomica.com.
2.2 These GTC exclusively govern the contractual relationship between you and us. Any terms and conditions you propose will not be part of the contract even if we do not expressly object.
2.3 These GTC are always available at https://autotomica.com/pages/agb and can be printed or downloaded for your records.
3. Registration
3.1 Registration is required to make purchases. This can be done during the order process or separately. After registration, we will create an account for you which you can use to manage your customer data such as delivery addresses.
3.2 Only individuals of legal age with full legal capacity, legal entities, and partnerships may register and order. If registering on behalf of a company, the individual must guarantee they have the authority to represent the company.
3.3 During registration, you must provide your name, billing and delivery address, telephone number, email address, and a password (hereinafter "access data").
3.4 By submitting the registration form, you make a binding offer to conclude the contract for account registration. Before submitting the form, you will have an opportunity to review and correct your entries.
3.5 Registration is complete when you receive a welcome email from us.
3.6 You must ensure that the information you provide is accurate and complete. If you provide false or incomplete information, we may terminate and delete your account without notice. You must inform us of any changes to your registration data immediately.
3.7 Account termination can be done in accordance with section 12. Your personal data will be deleted unless legal regulations permit or require continued storage. See our privacy policy for details.
3.8 You must not disclose your access data, especially your password, to third parties. If third parties gain access to your account or you suspect misuse, you must inform us immediately and change your access data.
3.9 There is no right to register and participate in the online shop. You are not entitled to register multiple times on www.autotomica.com.
4. Conclusion of Purchase Contract
4.1 The purchase contract is concluded as follows:
- 4.1.1 To initiate an order, place the desired item in the shopping cart by clicking the appropriate button.
- 4.1.2 Before finalizing the order, the entire order content will be displayed for review. You can modify your order before clicking the "Buy Now" button. After completion, you can no longer access the order details.
- 4.1.3 For payment methods not requiring immediate payment, a binding offer is made by clicking the "Buy Now" button. We confirm receipt of the order by email, but the purchase contract is only concluded upon dispatch confirmation. For SEPA transfer payments ("prepayment"), the dispatch confirmation serves as an order confirmation.
- 4.1.4 For payment methods requiring immediate payment (e.g. PayPal), our offer is made when the products are listed. The contract is accepted when you click the "Buy Now" button.
4.2 You can print your order details immediately after submitting your order. To view your order documents later, contact us via email or phone.
4.3 Changes to an order are possible before it has left our warehouse or been handed over to a shipping company.
4.4 We reserve the right to withdraw from the contract if the goods are not in stock due to reasons beyond our control. You will be informed immediately and any payments made will be refunded.
5. Replacement Items
5.1 Some products include a deposit value (e.g. generators) that you must pay in addition to the purchase price. After receiving the replacement item, return the defective old part at your expense and the deposit will be refunded.
5.2 Ensure all fluids are drained from returned parts and that the parts are reconditionable.
5.3 If returned parts are damaged, the deposit cannot be refunded.
6. Shipping and Delivery
6.1 Shipping costs within Germany:
- National delivery: approx. 5 - 6 days
- International delivery: approx. 6 - 8 days
6.2 Shipping costs within Germany are 8.99 EUR.
6.3 International shipping costs vary depending on the item. You can find the exact shipping costs below. If several items are ordered together, you only pay the highest shipping cost once.
6.4 Shipping costs by region:
- EU Countries: €19.99
- Non-EU European: €29.99
- North America: €99.00
- South America: €99.00
- Asia-Africa: €65.00
- Australia: €99.00
6.5 For non-EU countries, customs fees may apply and are the buyer's responsibility. Delays due to customs clearance may occur.
6.6 Shipping occurs within 5 working days upon the payment receipt. Note that there is no delivery on weekends or public holidays.
6.7 Additional charges for bulky items and special handling may apply. In the event of a return, these surcharges cannot be refunded.
7. Transfer of Risk
For corporate customers, the risk of accidental loss or deterioration passes to you once the item is handed over for transport or leaves our warehouse.
8. Acceptance of Goods/Transport Damage
8.1 If your order arrives damaged, report it to the parcel service employee and document the damage. This does not affect your warranty rights.
8.2 Refuse to accept damaged goods and contact us immediately for assistance.
9. Prices and Payment Methods
9.1 Various payment methods are available; see product pages for options.
9.2 Currencies are subject to change depending on the customers’ delivery address. Exchange rates are calculated automatically.
9.3 Prices at the time of order are valid. Total payment including shipping is due immediately.
- Credit card: Enter card details on a secure page.
- PayPal: Complete payment via your PayPal account.
- Bank Transfer: Transfer the amount to our bank account using provided details.
- Klarna: Pay by invoice within 30 days or via instant bank transfer.
- Apple Pay: A secure payment technology that allows users to make payments using their Apple devices quickly and securely.
- Google Pay: A fast, simple way to pay with your Google account on websites, in apps, and in stores.
- PAYMENT BY INVOICE (B2B ONLY): Enables businesses to pay through an invoice, ideal for B2B transactions, subject to credit approval.
9.5 Identity verification may be required for secure payment. Failure to provide requested information may result in order cancellation.
10. Default/Right of Retention
10.1 Reminder fees of €2.50 may apply if you default on payment. No costs for the first reminder.
10.2 Interest on late payments is five percentage points above the base interest rate for consumers and nine percentage points for businesses.
10.3 Further damages caused by default may be claimed.
10.4 Offsetting claims against us or asserting a right of retention is only permitted if your counterclaim is undisputed or legally binding.
11. Retention of Title
11.1 We retain title to all delivered items until full payment is received.
11.2 You must handle the goods with care.
11.3 Goods must not be pledged or assigned as security until fully paid. Inform us immediately of any third-party access to our goods.
11.4 For entrepreneurs:
- Retention of title applies to all current and future claims.
- We retain ownership until all secured claims are settled.
- Processing or transformation of goods is done for us. We acquire joint ownership if mixed with other items.
12. Term Suspension and Termination of Account
12.1 Account registration is for an indefinite period.
12.2 You may terminate your account registration at any time without notice.
12.3 We may terminate with two weeks’ notice.
12.4 We may terminate without notice for good cause such as providing false information or repeated contractual violations.
12.5 After termination, you may not register again.
12.6 Terminations must be in writing, including email.
13. Warranty
13.1 Your rights for defects are governed by statutory provisions.
13.2 Warranty rights expire within 1 year for new items and one year for used items from the transfer of risk.
13.3 In the event of a warranty claim, you may choose return or replacement. Disproportionate costs may limit the choice.
13.4 We do not cover costs for installation or removal.
13.5 Liability for defects in used items is excluded for businesses.
13.6 The following do not constitute material defects:
- Natural wear and tear
- Improper use
- Incorrect care
- Incorrect assembly
14. Checking the Fit
Before installation, visually compare the purchased item with the original part. Contact us if there are visible differences.
15. Manufacturer Warranties
If a manufacturer's warranty is available, it will be indicated in the product description. Claims are based on the manufacturer's conditions.
16. Seller’s Liability for Damages
16.1 We are liable without limitation for intent, gross negligence, and damages from injury to life, body, or health.
16.2 For slight negligence, we are liable for breach of material contractual obligations.
16.3 Liability excludes lack of economic success, lost profits, and indirect damages.
16.4 Liability is limited to typical and foreseeable damage.
16.5 The limitations apply to our employees, agents, and vicarious agents.
16.6 Liability under the Product Liability Act remains unaffected.
17. Set-Off and Right of Retention
17.1 You may only offset claims against our claims if your counterclaim is undisputed or legally binding.
17.2 You may assert a right of retention if your counterclaim is based on the same contractual relationship.
18. Code of Conduct and Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr/. We are not obliged and are unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
19. Final Provisions
19.1 These GTC are governed by German law excluding the UN Sales Convention.
19.2 The place of jurisdiction for all disputes is our place of business, provided you are a merchant, a legal entity under public law, or a special fund under public law.
19.3 If any provision of these GTC is invalid, the remaining provisions shall remain unaffected.
